Terms and Conditions for Mustafa Application

1 The Lucky Draw
  • 1.1 Customers making a Qualifying Purchase are offered opportunities to enter one or more Draws for chances to win cash prizes (the “Lucky Draw”).

  • 1.2 The organiser of this Lucky Draw. Mustafa’s Pte. Ltd. (UEN: 198000780C, Registered Address: 668 Chander Road, #02-18, Singapore 210668.

2 How to enter
  • 2.1 Entrants can enter this Lucky Draw by making a Qualifying Purchase (defined in 2.1.1) and completing the online entry form at https://mustafa-apps.com/customer/singapore/
    • 2.1.1 A “Qualifying Purchase” is the purchase of jewellery equal to or over SGD250 and/or of gold bars equal to or over SGD10,000 made during the Lucky Draw.
  • 2.2 There is no maximum Qualifying Purchase. A Qualifying Purchase entitles you to the following number of entries into the Lucky Draw:
    • 2.2.1 Every SGD250 spent on a single receipt on jewellery (i.e. gold, platinum, silver jewellery, diamonds and other precious stones) entitles you to one entry. Receipts cannot be combined.
      • For example:
      • A single receipt for SGD250 – one entry
      • A single receipt for SGD499.99 – one entry
      • Two receipts for SGD450 and SGD490 - two entries
      • A single receipt for SGD940 – three entries
    • 2.2.2 For purchases of gold bars, you are entitled to entries as follows:
      • A single receipt for SGD10,000 to SGD19,999 – one entry
      • A single receipt for SGD20,000 to SGD999,999 – two entries
      • A single receipt for SGD1,000,000 to 1,999,999 – three entries
      • A single receipt for SGD2,000,000 to 2,999,999 – four entries
      • A single receipt for SGD3,000,000 to 3,999,999 – five entries
    • With one additional entry being awarded for each subsequent one million Singapore dollars spent. Receipts cannot be combined.
  • 2.3 No additional payment is necessary to enter this Lucky Draw.
  • 2.4 By submitting an entry, you confirm that you are the natural person named on the entry and that you are not submitting the entry on behalf of anyone else, regardless of whether or not you have received their consent.
  • 2.5 By submitting an entry, you confirm that you have read and understood these terms and conditions and agree to be bound by them.
  • 2.6 We accept no responsibility for entries not successfully completed due to technical faults, malfunctions, computer hardware or software failure, satellite, network or server failure of any kind.
3 Dates
  • 3.1 The Lucky Draw Event starts on 9-Sep-2023 and ends on 5-Sep-2025. The following table shows the dates for Qualifying Periods and Draw Ceremonies.

Grand Annual Draw 2025

  • 3.2 The closing date and time for all entries to each draw are 11:59pm Singapore Time on the qualifying period end date.
  • 3.3 Each entry will be valid for at least one Grand Annual Draw. Depending on the date and time of entry you may also be eligible for one Monthly Draw and a further Grand Annual Draw.
  • 3.4 The purchase date (date on your receipt) and online entry date (date the entry is logged as submitted by our system) must both be within the same qualifying period in order to be eligible for the Monthly Draw.
    • For example, if you make a Qualifying Purchase on 6th September 2024 and:
      • Enter the Lucky Draw online on the 7th September 2024, you will be entered into draw number 26.
      • Enter the Lucky Draw online on 6th September 2024, you will be entered into draw numbers 12, 13 and 26.
4 Extension
  • 4.1 By entering this draw you understand that this Lucky Draw Event may be extended beyond the 6th September 2025. You give consent to be automatically re-entered into future draws. You may withdraw this consent at any time by emailing feedback@mustafajewellery.com.
5 Eligibility
  • 5.1 To enter this Lucky Draw, you must be:
    • (i) a natural person aged 21 or over at the time of entry
    • (ii) able to collect the prize as per section 9 (Prizes), paragraph 9.1, 9.2, and 9.3.
    • (iii) be able to receive the entry ID via WhatsApp
  • 5.2 The following persons are not eligible to enter:
    • (i) people who are prohibited under the laws of their country of citizenship, residency or domicile to participate in this Lucky Draw
    • (ii) citizens and/or residents of the United Kingdom, the European Union, the United States of America.
    • (iii) residents of Tamil Nadu, India.
  • 5.3 Entries will be void if they:
    • (i) do not comply with these terms and conditions;
    • (ii) are incomplete or illegible;
    • (iii) are considered by the organiser to be part of an attempt to manipulate or unfairly influence the outcome of this Lucky Draw
    • (iv) are based on a Qualifying Purchase which is subsequently refunded.
  • 5.4 We may ask for proof of your identity, age, residence or eligibility. Delay or failure to provide the evidence to our reasonable satisfaction may result in an entry being void or a prize being forfeited.
  • 5.5 Notwithstanding anything else stated in these terms and conditions, we have sole and final discretion to decide whether an entrant (or their entry) is eligible for this Lucky Draw and we are not obliged to provide any reasons for disqualification. In the event that we decide that an entrant (or their entry) is not eligible and if the prize has already been awarded, the prize must be returned forthwith.
6 Prize
  • 6.1 The prizes are supplied by Mustafa’s Pte Ltd as follows:
    • 6.1.1 For each Monthly Draw, there will be 5 prizes of USD5,000 each.
    • 6.1.2 For each Grand Annual Draw, there will be one prize of USD1,000,000.
  • 6.2 The winners are responsible for any costs or expenses involved in claiming or receiving the prize.
  • 6.3 The prize is for the named winner only and cannot be given to or collected by any other person.
7 Selection of the winner
  • 7.1 Winners of this Lucky Draw will be independently selected at random. Entries means all entries correctly submitted. Singapore entries must be submitted in accordance with these Singapore terms and conditions. Entries may also include entries submitted in other countries where Mustafa’s Pte Ltd has related companies in accordance with the terms and conditions applicable in that country. The random selection will be conducted using software run by 2Stallions Pte Ltd.
  • 7.2 Monthly draws will take place at Mustafa Jewellery, 145 Syed Alwi Rd, Mustafa Centre, Singapore 207704 at 12:00pm on the Draw Date in the table in paragraph 3.1. The location of the annual draw will be announced on our website and in national newspapers.
  • 7.3 The selection process will be overseen by an independent scrutineer.
8 Contacting the winner
  • 8.1 Winners will be listed on our website and published in a major Singapore daily newspaper within 7 days after the determination of the results.
  • 8.2 We will notify the winners by WhatsApp, email and post as soon as possible on or after the date of the Draw using the contact details provided in the entry.
  • 8.3 All prizes which remain unclaimed two months after the announcement of the winners, will be forfeited by the winner and donated to a Singapore Community Chest-approved charity.
9 Receiving the prize
  • 9.1 Winners must be able to collect prizes at the Singapore Draw Ceremony following the date that they have been announced as winners.
  • 9.2 Winners will be required to show photo ID and the unique entry ID received via WhatsApp at the time of entry.
  • 9.3 Lucky Draw winners are required to participate in publicity which may include attending Monthly or Grand Annual Draw Ceremonies to receive prizes, the publication of names, prizes, photographs, videos, interviews and attendance at additional Ceremonies. Winners’ names and the last 4 digits of their WhatsApp telephone number will be published in a Singapore daily newspaper and on our website.
  • 9.4 In all cases, we will provide the winner with instructions on how to obtain their prize.
  • 9.5 We are not liable for any loss to a prize caused by any third party. If a prize fails to be delivered or received, we have no obligation to provide a replacement prize.
10 Privacy and Use of Personal Data
  • 10.1 We respect the privacy and confidentiality of your personal data. We are committed to implementing policies, practices and processes to safeguard the collection, use and disclosure of the personal data you provide us, in compliance with the Singapore Personal Data Protection Act (PDPA) 2012. This section is to assist you in understanding how we collect, use, disclose, process, protect and retain your personal data that is in our possession.
  • 10.2 Personal data refers to any information that can uniquely identify an individual person (a) on its own, or (b) when combined with other information. We collect your personal data when you enter the Lucky Draw.
  • 10.3 The types of personal data we collect about you include your contact information (full name, WhatsApp telephone number, email address, postal address)
  • 10.4 Save for paragraph 10.5 below, we will use your personal information only for the purposes of conducting the Lucky Draw as outlined in these Terms and Conditions. This may include:
    • (i) Entering you in the Lucky Draw
    • (ii) Analysing your visits to our website
    • (iii) Communicating with you in matters related to your Lucky Draw entry (for example, informing you of a prize)
    • (iv) Responding to your inquiries and feedback to improve our quality of service
    • (v) Carrying out our obligations related to the Lucky Draw
    • (vi) Complying with legal obligations and regulatory requirements
    • (vii) Publishing of winners and other publicity as outlined in section 9 (Prizes), paragraphs 9.2 and 9.3.
  • 10.5 Optionally, upon submitting your entry to the Draw you may opt in via a check box to allow us to use your data for the purposes described next to the check box. This is optional and will NOT affect your entry into the Draw or influence the Lucky Draw results in any way. Should you opt in to this, you may subsequently opt out at any time by contacting us at feedback@mustafajewellery.com.
  • 10.6 We disclose some of the personal data you provide us to the following entities or organisations in order to fulfil our services to you:
    • (i) External professional service providers
    • (ii) Email Service Vendors
    • (iii) Cloud Service Providers
    • (iv) Organisers or persons connected with the organization of the Lucky Draw
    • (v) Where required to do so by law, we may disclose personal data about you to the relevant authorities or to law enforcement agencies.
  • 10.7 We will not collect more personal data than is necessary for the stated purpose. We will seek fresh consent from you if the original purpose for the collection, use or disclosure of your personal data has changed. However:
    • 10.7.1 Under certain circumstances, we may assume deemed consent from you when you voluntarily provide your personal data for the stated purpose, e.g. if you provide us with your bank details in order to receive prize money.
    • 10.7.2 We may rely on exceptions to the need for consent under the PDPA for the collection, use or disclosure of your personal data under the following circumstances:
      • (i) The personal data is publicly available
      • (ii) The personal data is disclosed by a public agency or disclosed to a public agency
      • (iii) The personal data is necessary for any investigation or proceedings
      • (iv) The personal data is necessary for evaluative purposes (e.g. determining the eligibility for a prize)
  • 10.8 If you wish to withdraw consent regarding your personal data, you should give us reasonable advance notice. We will advise you of the likely consequences of your withdrawal of consent, e.g. without your personal contact information we will not be able to enter you in future draws or inform you of future services offered by us. You can request for withdrawal of consent by emailing feedback@mustafajewellery.com
  • 10.9 We use “cookies” to collect information about your online activity on our website. A cookie is a small text file created by the website that is stored in your computer to provide a way for the website to recognise you and keep track of your preferences. The cookie makes it convenient for you such that you do not have to retype the same information again when you revisit the website or in filling electronic forms.
    • 10.9.1 Most cookies we use are “session cookies”, which will be deleted automatically from the hard disk of your computer at the end of the session.
    • 10.9.2 You may choose not to accept cookies by turning off this feature in your web browser. Note that by doing so, you may not be able to use some of the features and functions required to enter the Lucky Draw.
  • 10.10 You are only able to give consent for your own personal data. By entering this Draw you confirm that you have entered only your own personal particulars and consent to your own data being used as outlined in this section.
  • 10.11 It is important that you update us of any changes to your personal data. We will not be responsible if we are not able to inform you if you win any Draw due to you not informing us at feedback@mustafajewellery.com of a change in your WhatsApp telephone number, email and/or postal address.
  • 10.12 We have implemented appropriate measures to protect your data.
    • 10.12.1 We have implemented suitable information security and technical measures to protect the personal data we hold about you against loss; misuse; destruction; unauthorised alteration/modification, access, disclosure; or similar risks.
    • 10.12.2 We have also put in place reasonable and appropriate organisational measures to maintain the confidentiality and integrity of your personal data, and will only share your data with authorised persons on a ‘need to know’ basis.
    • 10.12.3 When we engage third-party data processors to process personal data on our behalf, we will ensure that they provide sufficient guarantees to us to have implemented the necessary organisational and technical security measures, and have taken reasonable steps to comply with these measures.
  • 10.13 In accordance with Gambling Control (Trade and Other Promotional Games and Lotteries — Class Licence) Order 2022 your personal data will be held for a period of 5 years from the date of the final Draw into which you are entered. We will not retain any of your personal data when it is no longer needed for any business or legal purposes and will dispose of or destroy such documents containing your personal data in a proper and secure manner when the retention limit is reached.
  • 10.14 You Can Access and Make Correction to Your Personal Data.
    • 10.14.1 You may write in to us to find out how we have been using or disclosing your personal data over the past one year. Before we accede to your request, we may need to verify your identity by checking your NRIC or other legal identification document. We will respond to your request as soon as possible, or within 30 days from the date we receive your request. If we are unable to do so within the 30 days, we will let you know and give you an estimate of how much longer we require. We may also charge you a reasonable fee for the cost involved in processing your access request.
    • 10.14.2 If you find that the personal data we hold about you is inaccurate, incomplete, misleading or not up-to-date you may ask us to correct the data. Where we are satisfied on reasonable grounds that a correction should be made, we will correct the data as soon as possible, or within 30 days from the date we receive your request.
  • 10.15 Where there is a need to transfer your personal data to another country outside Singapore, we will ensure that the standard of data protection in the recipient country is comparable to that of Singapore’s PDPA. If this is not so, we will enter into a contractual agreement with the receiving party to accord similar levels of data protection as those in Singapore.
  • 10.16 In the unlikely event that we suffer a data breach pertaining to unauthorised access or disclosure of personal data being stored or processed by us, we will meet the PDPA's breach notification timelines and requirements to perform the needful, including but not limited to informing relevant authorities and affected individuals, based on the Significant Harm or Significant Scale definitions as set out by the PDPA.
  • 10.17 If you have any query or feedback regarding this Notice, or any complaint you have relating to how we manage your personal data, you may contact our Data Protection Officer (DPO) at: dpo@privacy.com.sg.
    • 10.17.1 Any query or complaint should include, at least, the following details: (i) your full name and contact information and (ii) a brief description of your query or complaint.
    • 10.17.1 We treat such queries and feedback seriously and will deal with them confidentially and within reasonable time.
11 Our rights
  • 11.1 Our decision regarding any aspect of the Lucky Draw is final and binding and no correspondence will be entered into.
  • 11.2 We reserve the right to hold void, cancel, suspend, or amend the Lucky Draw where we deem it necessary to do so.
12 Our liability
  • 12.1 While nothing in these terms and conditions will limit our liability for death or personal injury caused by our negligence or for fraud, we will not be legally responsible to entrants or winners for any losses that were not foreseeable to us or to you at the time of entry to this Lucky Draw or which are caused by a third party.
  • 12.2 Your statutory rights are not affected. To the maximum extent permitted by law, each participant agrees to indemnify us against any losses, damages, costs, expenses, claims or liabilities of any kind arising in connection with their participation in this Lucky Draw.
13 Future changes to these Terms and Conditions
  • 13.1 We may from time to time be required to amend these Terms and Conditions, for example as a response to a change in legislation in Singapore. If this happens, we will email you at the email address you provide upon entering the Draw. If you don’t agree with any such amended Terms and Conditions, you may withdraw your entry into any future Draws by emailing feedback@mustafajewellery.com.

15 Applicable Law
  • 15.1 The laws of Singapore apply to these terms and conditions.
  • 15.2 Any disputes arising from or in connection with you entering into the Lucky Draw will be subject to the exclusive jurisdiction of the courts of Singapore.

    • 2.1.1 A “Qualifying Purchase” is the purchase of jewellery equal to or over MYR850 during the Contest.
  • 2.2 There is no maximum Qualifying Purchase. A Qualifying Purchase entitles you to the following number of entries into the Contest:
    • 2.2.1 Every MYR850 spent on a single receipt on jewellery (i.e. gold, platinum, silver jewellery, diamonds and other precious stones) entitles you to one entry. Receipts cannot be combined.
      • For example:
      • A single receipt for MYR850 – one entry
      • A single receipt for MYR1,600 – one entry
      • Two receipts for MYR1,000 and MYR1,200 - two entries
      • A single receipt for MYR2,700 – three entries
    • 2.2.2 For purchases of gold bars, you are entitled to entries as follows:
      • A single receipt for MYR35,000 – one entry
      • A single receipt for MYR70,000 – two entries
      • A single receipt for MYR3,400,000 – three entries
      • A single receipt for MYR6,800,000 – four entries
    • With one additional entry being awarded for each subsequent one million Malaysian Ringgit spent. Receipts cannot be combined.
  • 2.3 No additional payment is necessary to enter this Contest.
  • 2.4 By submitting an entry, you confirm that you are the natural person named on the entry and that you are not submitting the entry on behalf of anyone else, regardless of whether or not you have received their consent.

Grand Annual Contest 2025

  • 3.2 The closing date and time for all entries to each Contest are 11:59pm Singapore Time on the qualifying period end date.
  • 3.3 Each entry will be valid for at least one Grand Annual Contest. Depending on the date and time of entry you may also be eligible for one Contest and a further Grand Annual Contest.
  • 3.4 The purchase date (date on your receipt issued by Mustafa Jewellery in Malaysia) and online entry date (date the entry is logged as submitted by our system) must both be within the same qualifying period in order to be eligible for the Contest.
    • For example, if you make a Qualifying Purchase on 6th September 2024 and:
      • Enter the Contest online on the 7th September 2024, you will be entered into Contest number 26.
      • Enter the Contest online on 6th September 2024, you will be entered into Contest numbers 12, 13 and 26.
4 Extension
  • 4.1 By entering this Contest you understand that this Contest may be extended beyond the 6th September 2025. You give consent to be automatically re-entered into future Contests. You may withdraw this consent at any time by emailing feedback@mustafajewellery.com.
5 Eligibility
  • 5.1 To enter this Contest, you must be:
    • (i) a natural person aged 21 or over at the time of entry;
    • (ii) able to collect the prize as per section 9 (Prizes), paragraph 9.1;
    • (iii) be able to receive the entry ID via WhatsApp; and
    • (iv) a Malaysian citizen.
  • 5.2 The following persons are not eligible to enter:
    • (i) people who are prohibited under the laws of their country of citizenship, residency or domicile to participate in this Contest; and
    • (ii) people who are not Malaysian citizens.
  • 5.3 Entries will be void if they:
    • (i) do not comply with these terms and conditions;
    • (ii) are incomplete or illegible;
    • (iii) are considered by the organiser to be part of an attempt to manipulate or unfairly influence the outcome of this Contest; or
    • (iv) are based on a Qualifying Purchase which is subsequently refunded.
  • 5.4 We may ask for proof of your identity, age, residence or eligibility. Delay or failure to provide the evidence to our reasonable satisfaction may result in an entry being void or a prize being forfeited.
  • 5.5 Notwithstanding anything else stated in these terms and conditions, we have sole and final discretion to decide whether an entrant (or their entry) is eligible for this Contest and we are not obliged to provide any reasons for disqualification. In the event that we decide that an entrant (or their entry) is not eligible and if the prize has already been awarded, the prize must be returned forthwith.
6 Prize
  • 6.1 The prizes are supplied by Mustafa’s Pte Ltd as follows:
    • 6.1.1 For each Contest, there will be 5 prizes of USD5,000 each.
    • 6.1.2 For each Grand Annual Contest, there will be one prize of USD1,000,000.
  • 6.2 The winners are responsible for any costs or expenses involved in claiming or receiving the prize.
  • 6.3 The prize is for the named winner only and cannot be given to or collected by any other person.
7 Selection of the winner
  • 7.1 Winners of this Contest will be independently selected by the organiser and/or administrator (as the case may be) based on the most creative answer to the quiz question in the entry format. Entries means all entries correctly submitted. Malaysia entries must be submitted in accordance with these Singapore terms and conditions. Entries may also include entries submitted in other countries where Mustafa’s Pte Ltd has related companies in accordance with the terms and conditions applicable in that country.
  • 7.2 Monthly winner will be announced take place at Mustafa Jewellery, 145 Syed Alwi Rd, Mustafa Centre, Singapore 207704 at 12:00pm on the Contest Date in the table in paragraph 3.1. The location of the annual contest winner announcement will be announced on our website and in national newspapers.
  • 7.3 The selection process will be overseen by an independent scrutineer.
8 Contacting the winner
  • 8.1 Winners will be listed on our website.
  • 8.2 We will notify the winners by WhatsApp, email and post as soon as possible on or after the date of the Contest using the contact details provided in the entry.
  • 8.3 All prizes which remain unclaimed two months after the announcement of the winners, will be forfeited and donated to a Singapore Community Chest-approved charity.
9 Receiving the prize
  • 9.1 Winners must be able to collect prizes in Singapore in person.
  • 9.2 Winners will be required to show photo ID and the unique entry ID received via WhatsApp at the time of entry.
  • 9.3 Contest winners are required to participate in publicity which may include attending Monthly or Grand Annual Contest Ceremonies to receive prizes, the publication of names, prizes, photographs, videos, interviews and attendance at additional Ceremonies. Winners’ names and the last 4 digits of their WhatsApp telephone number will be published in a Singapore daily newspaper and on our website.
  • 9.4 In all cases, we will provide the winner with instructions on how to obtain their prize.
  • 9.5 We are not liable for any loss to a prize caused by any third party. If a prize fails to be delivered or received, we have no obligation to provide a replacement prize.
10 Privacy and Use of Personal Data
  • 10.1 We respect the privacy and confidentiality of your personal data. We are committed to implementing policies, practices and processes to safeguard the collection, use and disclosure of the personal data you provide us, in compliance with the Malaysia Personal Data Protection Act (“PDPA”). This section is to assist you in understanding how we collect, use, disclose, process, protect and retain your personal data that is in our possession.
  • 10.2 Personal data refers to any information that can uniquely identify an individual person (a) on its own, or (b) when combined with other information. We collect your personal data when you enter the Contest.
  • 10.3 The types of personal data we collect about you include your contact information (full name, WhatsApp telephone number, email address, postal address)
  • 10.4 Save for paragraph 10.5 below, we will use your personal information only for the purposes of conducting the Contest as outlined in these Terms and Conditions. This may include:
    • (i) Entering you in the Contest
    • (ii) Analysing your visits to our website
    • (iii) Communicating with you in matters related to your Contest entry (for example, informing you of a prize)
    • (iv) Responding to your inquiries and feedback to improve our quality of service
    • (v) Carrying out our obligations related to the Contest
    • (vi) Complying with legal obligations and regulatory requirements
    • (vii) Publishing of winners and other publicity as outlined in section 9 (Prizes), paragraphs 9.2 and 9.3.
  • 10.5 Optionally, upon submitting your entry to the Contest you may opt in via a check box to allow us to use your data for the purposes described next to the check box. This is optional and will NOT affect your entry into the Contest or influence the Contest results in any way. Should you opt in to this, you may subsequently opt out at any time by contacting us at feedback@mustafajewellery.com.
  • 10.6 We disclose some of the personal data you provide us to the following entities or organisations, which may belocated outside Malaysia and/or Singapore, in order to fulfil our services to you:
    • (i) our headquarters, regional offices, subsidiaries, affiliates and/or members within the Mustafa Jewellery group of companies
    • (ii) External professional service providers
    • (iii) Email Service Vendors
    • (iv) Cloud Service Providers
    • (v) Organisers,administrators, or persons connected with the organization and administration of the Contest
    • (vi) Where required to do so by law, we may disclose personal data about you to the relevant authorities or to law enforcement agencies.
  • 10.7 We will not collect more personal data than is necessary for the stated purpose. We will seek fresh consent from you if the original purpose for the collection, use or disclosure of your personal data has changed. However:
    • 10.7.1 Under certain circumstances, we may assume deemed consent from you when you voluntarily provide your personal data for the stated purpose, e.g. if you provide us with your bank details in order to receive prize money.
    • 10.7.2 We may rely on exceptions to the need for consent under the PDPA for the collection, use or disclosure of your personal data under the following circumstances:
      • (i) The personal data is publicly available
      • (ii) The personal data is disclosed by a public agency or disclosed to a public agency
      • (iii) The personal data is necessary for any investigation or proceedings
      • (iv) The personal data is necessary for evaluative purposes (e.g. determining the eligibility for a prize)
  • 10.8 If you wish to withContest consent regarding your personal data, you should give us reasonable advance notice. We will advise you of the likely consequences of your withContestal of consent, e.g. without your personal contact information we will not be able to enter you in future Contests events or inform you of future services offered by us. You can request for withContestal of consent by emailing feedback@mustafajewellery.com
  • 10.9 We use “cookies” to collect information about your online activity on our website. A cookie is a small text file created by the website that is stored in your computer to provide a way for the website to recognise you and keep track of your preferences. The cookie makes it convenient for you such that you do not have to retype the same information again when you revisit the website or in filling electronic forms.
    • 10.9.1 Most cookies we use are “session cookies”, which will be deleted automatically from the hard disk of your computer at the end of the session.
    • 10.9.2 You may choose not to accept cookies by turning off this feature in your web browser. Note that by doing so, you may not be able to use some of the features and functions required to enter the Contest.
  • 10.10 You are only able to give consent for your own personal data. By entering this Contest you confirm that you have entered only your own personal particulars and consent to your own data being used as outlined in this section.
  • 10.11 It is important that you update us of any changes to your personal data. We will not be responsible if we are not able to inform you if you win any Contest due to you not informing us at feedback@mustafajewellery.com of a change in your WhatsApp telephone number, email and/or postal address.
  • 10.12 We have implemented appropriate measures to protect your data.
    • 10.12.1 We have implemented suitable information security and technical measures to protect the personal data we hold about you against loss; misuse; destruction; unauthorised alteration/modification, access, disclosure; or similar risks.
    • 10.12.2 We have also put in place reasonable and appropriate organisational measures to maintain the confidentiality and integrity of your personal data, and will only share your data with authorised persons on a ‘need to know’ basis.
    • 10.12.3 When we engage third-party data processors to process personal data on our behalf, we will ensure that they provide sufficient guarantees to us to have implemented the necessary organisational and technical security measures, and have taken reasonable steps to comply with these measures.
  • 10.13 We will not retain any of your personal data when it is no longer needed for any business or legal purposes and will dispose of or destroy such documents containing your personal data in a proper and secure manner when the retention limit,if any, is reached.
  • 10.14 You Can Access and Make Correction to Your Personal Data.
    • 10.14.1 You may write in to us to find out how we have been using or disclosing your personal data over the past one year. Before we accede to your request, we may need to verify your identity by checking your NRIC or other legal identification document. We will respond to your request as soon as possible, or within 30 days from the date we receive your request. If we are unable to do so within the 30 days, we will let you know and give you an estimate of how much longer we require. We may also charge you a reasonable fee for the cost involved in processing your access request.
    • 10.14.2 If you find that the personal data we hold about you is inaccurate, incomplete, misleading or not up-to-date you may ask us to correct the data. Where we are satisfied on reasonable grounds that a correction should be made, we will correct the data as soon as possible, or within 30 days from the date we receive your request.
  • 10.15 Where there is a need to transfer your personal data to another country outside Malaysia, we will ensure that the standard of data protection in the recipient country is comparable to that of Malaysia's PDPA. If this is not so, we will enter into a contractual agreement with the receiving party to accord similar levels of data protection as those in Malaysia.
  • 10.16 In the unlikely event that we suffer a data breach pertaining to unauthorised access or disclosure of personal data being stored or processed by us, we will meet the PDPA's and requirements to perform the needful.
  • 10.17 If you have any query or feedback regarding this Notice, or any complaint you have relating to how we manage your personal data, you may contact our Data Protection Officer (DPO) at: dpo@privacy.com.sg.
    • 10.17.1 Any query or complaint should include, at least, the following details: (i) your full name and contact information and (ii) a brief description of your query or complaint.
    • 10.17.1 We treat such queries and feedback seriously and will deal with them confidentially and within reasonable time.
11 Our rights
  • 11.1 Our decision regarding any aspect of the Contest is final and binding and no correspondence will be entered into.
  • 11.2 We reserve the right to hold void, cancel, suspend, or amend the Contest where we deem it necessary to do so.
12 Our liability
  • 12.1 While nothing in these terms and conditions will limit our liability for death or personal injury caused by our negligence or for fraud, we will not be legally responsible to entrants or winners for any losses that were not foreseeable to us or to you at the time of entry to this Contest or which are caused by a third party.
  • 12.2 Your statutory rights are not affected. To the maximum extent permitted by law, each participant agrees to indemnify us against any losses, damages, costs, expenses, claims or liabilities of any kind arising in connection with their participation in this Contest.
13 Future changes to these Terms and Conditions
  • 13.1 We may from time to time be required to amend these Terms and Conditions, for example as a response to a change in legislation in Singapore or Malaysia. If this happens, we will email you at the email address you provide upon entering the Contest. If you don’t agree with any such amended Terms and Conditions, you may with Contest your entry into any future Contests by emailing feedback@mustafajewellery.com.

15 Applicable Law
  • 15.1 The laws of Malaysia apply to these terms and conditions.
  • 15.2 Any disputes arising from or in connection with you entering into the Contest will be subject to the exclusive jurisdiction of the courts of Malaysia.
